In principle: Legal studies and analyses, no. 1/2023

The seventh issue of our semiannual scholarly journal In principle: Legal studies and analyses has now been published: 100 pages, 8 authors, 6 articles. We invite you to read it (in Polish, with English abstracts).

We start with reprivatisation. The so-called Warsaw Decree has been in force for 77 years, but despite the wealth of court decisions applying it, it still generates disputes in interpretation, for example over who can be a party to proceedings under the decree.

We pose several questions in this issue. Should the tax authorities have nearly unlimited access to information protected by banking secrecy? What constitutes discrimination in employment law, and could the rules and solutions developed under British law be applied also under Polish law?

We discuss a bill to amend the Fiscal Penal Code. While this specific draft has been withdrawn, elements of it may reappear the next time Polish tax laws or criminal laws are amended.

Food waste is a pressing legal, economic, and ethical issue. Nearly five million tonnes of food is wasted in Poland every year! What legal mechanisms (or measures adopted by producers themselves) could reduce this problem? Which of the existing solutions actually make the problem worse?

This issue also includes a critical commentary on a judgment that has stirred protest in the tourism industry, as, the author argues, it can be interpreted to legitimise the activities of unregulated operators.
